This website, https://www.marefind.com, (hereinafter called the “Website”) has been created by, and is the property of MAREFIND INTERNATIONAL Ltd (hereinafter “MAREFIND”), a Company incorporated and operating under Cyprus Law, with registered office in Nikou Theofanous 4, Palouriotisa, 1040- Nicosia, Cyprus, with TIC and VAT 10394164T.
The Website has been developed and operates with the purpose of MAREFIND providing the website users with the following services:
• online employment opportunities and networking services for the sole purpose of individuals (Service Providers) looking for marine crew or office work employment opportunities, and
• employers (Service Users) seeking to recruit such individuals / staff (freelance or permanent)
MAREFIND is the sole owner and beneficiary of the content introduced onto the website, and has obtained the necessary authorizations to use the information it posts.

1.2 MAREFIND provides its Services through the present website, www.marefind.com (the “Website”).
1.6 Whenever a User is required to sign up to receive and/or manage the Services requested or received from MAREFIND, the latter may unilaterally amend, at its discretion, both the procedure and the data and information that the user must enter to sign up and login on his online account, including, but not limited to, his email address, mobile phone, etc. Failure to follow the required procedure and/or enter the requested information, may result in blocked access to the user’s online account and to the Services.
2.1 “Contact” means the related Contacting or Networking Service and the potential arrangement for service conferred upon the Service Provider by the Service User.
2.2 “Content” means all offers, messages or information of any nature whatsoever (text, images, videos, photographs, comments, marks, company names, etc.) uploaded by a Website Member.
2.3 “Company” MAREFIND INTERNATIONAL Ltd (hereinafter “MAREFIND”), a Company incorporated and operating under Cyprus Law, with registered office in Nikou Theofanous 4, Palouriotisa, 1040 Nicosia, Cyprus, with TIC and VAT 10394164T.
2.5 “Member” means a Service Provider or a Service User who is registered to and uses the Website’s Website.
2.6 “Profile Verification” an option indicating whether a profile has undergone special Verification
2.7 “Premium Subscription” means a paid subscription giving access to the paid Premium Services offered by MAREFIND for a specified / limited period.
2.8 “Service Provider” means a natural person / Member registered on the Website, willing to offer his/hers services and carry out the Contact requested by a Service User
2.9 “Service User” means a Member (Legal Entity / Company or natural person), wishing to hire the services of a Service Provider via the Website.
2.10 “Job Post” means a post published by a “Service User” indicating their job requirements for a specific position.
2.11 “User” means any person using the Website, whether he / she is just a visitor or a Member.
2.12. “VIP Subscription” means a paid subscription allowing a VIP Member to receive targeted “Job Matching” services for a specified / limited period.
2.13 “MareChat” means an online chat system created for the internal and sole communication use between the premium subscribers.
2.14 “Website” means www.marefind.com
2.15 “Website Service” means all free or paid services offered by MAREFIND via the Website www.marefind.com
3.1 A User needs to register in the Website as a member (Website Member) in order to participate in a Contacting / Networking service. Service Providers can advertise their services via the Website and Service Users can access the Website to locate a suitable Service Provider as well as to publish Jobs Posts.
3.2 In order to become a Member, the User must provide all information marked as mandatory when completing a form available online on the Website. This information must be correct, up-to-date, truthful, and proved upon MAREFIND’s first request, as well as updated regularly by the Member via the user’s profile menu.
3.3 More specifically, a Member must specify a valid e-mail address which will allow him/her to confirm their registration as well as a telephone number on which they can be contacted.
3.5 The Member undertakes to only personally use the Website and refrain from allowing any third party access thereto in his/her place or on his/her behalf. The Member agrees and undertakes to create just one account.
Upon successful initial verification, the User follows on to enter, in the suitable online forms, his/hers further personal / company profile details, including, indicatively:
• For Service Users / Employers: Company or Person Name, email, Location / Address, Job request details etc
Fields that are mandatory are marked with an * asterisk.
3.7 Users / Members’ Passwords should be for strong (8+ complex). Each Member undertakes to ensure that his/her username and password are kept secret. Any Contact carried out using the Member’s username and password will be deemed to have been completed by such Member, and this Member will therefore be solely responsible for this.
3.8 If a User / Member forgets his/hers password, he/she has to follow the “Forgot Password?” procedure, by following the steps within the Website’s Log-in page.
3.10 By applying to be a Member, the Member warrants that he/she is at least 18 years old.
3.11 By posting a profile, a Service Provider agrees that MAREFIND forwards this profile to partners in order to maximize their chances of finding a Contact.
3.12 By posting a Contact request, a Service User agrees that MAREFIND forwards this Contact to partners in order to maximize their chances of finding a Contact or a Service Provider.
3.13 “Remarks” – “rating” of Service Providers: Service Users, who have had experience from contacting / collaborating with a specific Service Provider, are entitled to (optionally) enter online their evaluation about this Service Provider, in the related Website menu. In doing so, they can enter a 1-up-to-5 star evaluation in fields related to Cooperation, Communicative Competence, Collaboration, Consistency etc, while being able to keep their Anonymity.
3.14 Where you are a Service Provider, you warrant that all services provided by you to a Service User will comply with all relevant applicable legislation and regulations and that you hold all appropriate licenses and registrations.
3.15 If a User knows or suspects that anyone other than the User knows the User identification code or password, he/she must promptly notify us at firstname.lastname@example.org
4.1 In order to guarantee, to a Service User, the accuracy of the information provided by a Service Provider called upon to complete Personal Contacts, MAREFIND may proceed to a “Profile Verification process. This Verification consists of verifying the identity and personal details held by Service Providers who have opted for the Verification service.
4.2 Identity verification for the Service Providers includes submitting an electronic copy of their authenticating documents (Identity Card, Passport, Residence Permit or Document valid for residents from outside the European Union). MAREFIND will verify that the surname, first name and age submitted during registration on the Website are consistent. Documents upon the completion of the verification process are immediately deleted and destroyed from MAREFIND's system/ email.
5.1 MAREFIND acts as a Website offering online employment opportunities and networking services for Service Users and Service Providers. When a Service Provider and Service User enter into agreement for the supply of services with respect to a Contact, the agreement will be directly between the Service Provider and the Service User.
5.2 MAREFIND is not a party to any contractual relationship between the Service Provider and the Service User (whether oral, written or other). It is up to the a Member to ensure that he/she is satisfied of the suitability of any engagement, to confirm the identity and the status of those involved and to check any credentials. MAREFIND has no supervision or responsibility for the behavior of any Service Provider, Service User or any third party making use of the Website and disclaims any liability.
5.3 MAREFIND is not a manning agent.
5.4 Exclusion of Liability related to the use of the Website’s services as related to various Countries’ Laws governing the recruitment and employment of overseas workers (eg. like POEA): As also stated in 5.2, MAREFIND, is not a party to any contractual agreement and, is not, in any way, liable and not in charge for any recruitment / employment. This responsibility / act falls solely between the Service Users and the Service Providers relationship as well as their manning agents.
5.5 Members acknowledge and agree that when they post profiles and/or Contact requests on the Website, MAREFIND is not acting as an agent of any visitors to the Website or as an agent of any Service User and/or Service Provider.
5.6 MAREFIND does not endorse any comments, opinions or reviews made by anyone on the Website and does not review their accuracy or content, but reserves the right to remove any comments, opinions, reviews or other materials from the Website which do not comply with the acceptable use policy set out in clauses 10 to 12 inclusive.
5.7 Without prejudice to the generality of the above:
(a) where a Member is a Service User, the Service User will be solely responsible for the engagement of a Service Provider on terms acceptable to the Service User, for verification of Service Provider’s identity, qualifications, credentials and experience and for all necessary direction, supervision and control;
(b) where a Member is a Service Provider, he/she acknowledges that MAREFIND does not guarantee any recruitment or engagement with a Service User and must satisfy the suitability of any Contact with a Service User.
5.7 MAREFIND may provide links on the Website to websites of other Companies, whether affiliated with MAREFIND or not. MAREFIND cannot give any undertaking that products or services (which a Member purchases from third party sellers / providers through the Website or from Companies to whose website MAREFIND has provided a link on the Website) will be of satisfactory quality, and any such warranties are disclaimed by MAREFIND absolutely. This disclaimer does not affect a Member’s statutory rights against any third party seller.
5.9 A Member shall indemnify MAREFIND against all costs, claims, damages, losses and expenses arising as a result of any claim or action suffered by MAREFIND in the event:
(c) of any dispute between any Service User and Service Provider.
5.10 Access to and registration on the Website are free of charge. The Website’s services / usage can be free of charge or paid - depending on the services required (Premium and VIP services are based on paid subscriptions).
5.11 Access to the Website is permitted on a temporary basis, and MAREFIND reserves the right to withdraw or amend the Services on the Website without notice (see below). MAREFIND will not be liable if, for any reason, the Website is unavailable at any time or for any period.
5.12 From time to time, MAREFIND may restrict access to some parts or the entire Website, to Members who have registered in the Website.
5.14 When a Member uses the Website, the Member must comply with the provisions of the acceptable use policy set out in clauses 8 to 11 inclusive.
6.1 MAREFIND is the owner or the licensee of all intellectual property rights in the Website, and in the material published on it, including Software applications, Databases etc. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.
6.2 Members must not use any part of the materials on the Website for commercial purposes without obtaining a permit / license to do so from MAREFIND or any related MAREFIND’s licensors.
6.3 The Website is a trademark and a domain name owned by MAREFIND INTERNATIONAL Ltd.
7.1 Premium Subscription offered to Service Providers
Premium Subscriptions for Service Providers are based on a paid subscription basis
The Verification procedure gives a Service Provider the possibility to sign up for the Premium Subscription service, allowing him/her to take advantage of the following benefits (he/she then becomes a “Premium Service Provider”):
a) Profiles of Premium Service Providers will appear at the top of the results list following a default search carried out by a Service User.
b) MareChat Available
7.2 Premium Subscription for Service Users
Premium Subscriptions for Service Users are based on a paid subscription basis
Any Member / Service User may sign up for the Premium Subscription Service, allowing them to take advantage of the following benefits (they become “Premium Service Users”):
a) Job Posts of a Premium Service User will appear at the top of the results list following a default search carried out by Service Provider.
b) Premium Service Users may access unlimited Service Providers’ accounts
c) Premium Service Users may compare and contrast Service Providers’ accounts that match their choice.
d) Premium Service Users will have access to the telephone numbers and other contact details of all Service Providers who have agreed to provide these, it being specified that access to Service Provider’ telephone numbers is only granted once a response from the Service Provider has been received via the internal messaging service;
e) Premium Service Users may view evaluations published by other Service Users in relation to Service Providers Contacts.
f) MareChat Available
g) Offline-VIP Services: Within the VIP service, MAREFIND proceeds at once to search, on account of a VIP Service User, profiles of Service Providers - based on the criteria which the VIP Service User has set (“Jobs Matching” Service). Later on, MAREFIND conducts an availability check and sends to the VIP Service User the Profiles of those Service Providers who are immediately available and suit his needs, as well as their relevant contact information (the number of CVs is not specified, but in any case it will be minimum 2 profiles - maximum 6). The responsibility for the selection and the final contact with the available Service Providers Professionals belongs to the VIP Service User. In case the VIP Service User begins a Contact with a Service Provider, the VIP Service User will have no further financial obligation towards MAERFIND, while the whole financial and professional transaction is defined and concerns solely the VIP Service User and the Service Provider.
7.3 Subscriptions Price List
• The Prices for Premium or VIP Subscriptions can be found on the Website in the dedicated area (“Subscriptions”).
• The prices shown on the Website next to each offered subscription service represent the total price for the specific service, excluding all corresponding taxes and duties.
• No additional fees payable to MAREFIND for the services offered through the Website, as these apply at the price given in the Subscription page and time of subscription / transaction completion, unless otherwise specified on the Website.
• The Price of each service will be paid in the manner indicated on the Website. Payment methods are through PayPal, JCC and Bank Transfer (see also in 7.5. below).
• Prices may change from time to time, reflecting changes in the Market and/or Technology
• All new 'Service User' Members get their first two Contacts free of charge
• All 'Service User' Members are entitled to earning “Credits” (see in 7.6 below)
7.4 Payment Procedure
• The payment of each service will be paid in the manner indicated on the Website.
• MAREFIND uses payment management services from third parties (using PayPal, JCC or Bank Transfer) to process the Member’s subscription payments.
• Payment processing services provided by PayPal (www.paypal.com) are subject to PayPal’s own Terms of Service. A subscription-based Website Member is responsible for choosing / opening a suitable PayPal Account and Payment Method, according to PayPal’s Terms of Service / Payments.
• Payments processing services provided through JCC (www.jcc.com.cy portal) are also subject to the JCC platform’s own Terms of Service and according to JCC & cooperating Bank’s credit / debit card payment procedures.
• In any of the above mentioned payment scenarios, MAREFIND does not request / register / store any Members’ credit / debit card details in any of its systems. For the final payment of a subscription-based service, the User is directed to the PayPal / JCC site’s environment, where the payment procedure is concluded. MAREFIND only receives and stores a verification that a specific Member has successfully concluded the necessary payment procedure / amount.
• All Website 'Service User' are entitled to earning “Credits”.
• Credits can be earned by suggesting “Friends” to the Website and following the activation of the Friend’s - new Member’s account from his side (this can be done via email, Facebook or by pasting a unique link)
• Credits can be redeemed for subscriptions renewals, only online - for the online services of MAREFIND - and they cannot be exchanged with money (1 credit “equals” 1 euro).
• For example, with 1.5 credits (=1.5 €) a Member can have a 1.5 € discount on the paid services of Marefind.
• Credits can also be lost (e.g. loosing 0.70 credits if MAREFIND gets a report about a Service Provider (Crew/Sea-Professional) from a Service User (Company) or vice-versa
• Credits reports are always monitored and evaluated by MAREFIND
7.6 Subscription Renewal
• Members wishing to renew their subscriptions should do this in good time.
• All subscriptions’ renewals charges take place (at the earliest) 24 hours before the expiration of the subscription. For instance, if a subscription expires on 10/05/2019 at 12:00, the charge will take place on 09/05/2019 at 12:00. In case the subscription charging fails (due to insufficient amount, card expiration or any other reason), the Member will receive a warning message that the charging has failed and that his subscription will end. If the Member sees the message, he/she can log into his/her account and proceed to a new payment procedure. In this manner, the Member has the opportunity to renew his/her subscription on time.
• A Member is entitled not to renew his/hers subscription, by cancelling it not later than 2 days before the subscription’s renewal date / time.
• In some cases, the subscription expiration time can happen to be at 00:00 midnight. In these cases, the charging will take place at 00:00 midnight of the previous day. In the previous paragraph’s example, the charging would take place on 09/05/2019 at 00:00. In this case it is advisable that the cancellation of the subscription by the Member takes place at least two (2) days before (for example, on 09/05, 23:59).
8.1 Comments and other materials posted on the Website are for guidance purposes only. MAREFIND therefore disclaims all liability and responsibility arising from any reliance placed on such materials by any visitor to the Website, or by anyone who may be informed of any of its contents. The Member must make all appropriate investigations before entering into an engagement with a Service User or Service Provider.
8.2 MAREFIND aims to update the Website regularly, and may change the content at any time. If the need arises, MAREFIND may suspend access to the Website, or close it indefinitely. Any of the material on the Website may be out of date at any given time, and MAREFIND is under no obligation to verify or update such material.
8.3 Any information is provided only for personal use and it must not be used for any further commercial purpose, such as the resale or further distribution to a wider audience.
9.2 In no event shall MAREFIND be liable to a Member, whether based on contract or tort or any other legal theory, including without limitation strict liability, gross negligence or negligence in connection with:
(b) direct, indirect or consequential loss or damage incurred by any Member in connection with the Services, on the Website or in connection with the use, inability to use, or results of the use of the Website, any websites linked to it and any materials posted on it, including, without limitation, any liability, damages to and loss of property, for loss of income or revenue; loss of business; loss of profits or contracts; loss of anticipated savings; loss of data; loss of goodwill; wasted management or office time; and for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable;
(c) any liability for death or personal injury arising to any Member from an Contact;
9.3 MAREFIND shall not be held liable for death or personal injury or damages and loss of property due to MAREFIND’s negligence or fraudulent misrepresentation by any Member.
9.5 MAREFIND will not be liable for any loss or damage caused by a distributed denial-of-service (DDOS) attack, viruses or other technologically harmful material or Hacking attack that may infect a Member’s computer equipment, computer programs, data or other proprietary material due to his/hers use of the Website or to any downloading of any material posted on it, or on any website linked to it.
9.6 Notwithstanding the above, the Service Provider and the Service User respectively hereby agree to defend, hold harmless, and indemnify, to the fullest extent possible, MAREFIND, its employees, officers, directors, agents and shareholders (each an “Indemnitee” and collectively “Indemnitees”) from and against all liabilities, losses, damages, judgments, fines, amounts paid in settlement, expenses and costs of defense, including without limitation reasonable attorneys’ fees and witness fees, resulting from any past, present, or future claim, demand, suit, action, or proceeding, arising out of or relating in any way to any unlawful act or omission, or willful misconduct of Service Provider or Service User during the course of an Contact.
9.7 MAREFIND reserves the right at its absolute discretion and without any notification or prior notice, unless otherwise provided for by the applicable law from time to time, to indicatively and not restrictively proceed to any of the following actions or to more than one actions or to all such actions cumulatively:
a) to register and record - maintain registered any communication (or part thereof) of the User / Member with the webpage, including e-mail communications and questions – answers addressed to experts or other persons
c) to decide at its absolute discretion to withdraw, to terminate the uploading or to require the withdrawal of any communication and to proceed to any other legal action for the protection of its rights and interests
10.1 A Member may not use the Website:
• in any way that breaches any applicable National or International law or regulation; in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;
• for the purpose of harming or attempting to harm others and/or minors in any way;
• to send, knowingly receive, upload, download, use or re-use any material which does not comply with our acceptable use policy as set out in clauses 5 & 9 inclusive;
• to transmit or procure the sending of, any unsolicited or unauthorized advertising or promotional material or any other form of similar solicitation (spam);
• to knowingly transmit any data, send or upload any material that contains Malware (Viruses, Trojan horses, Worms, time-bombs, keystroke loggers, Spyware, Adware) or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.
10.2 A Member also agrees not to access without authority, interfere with, damage or disrupt:
• any part of the Website;
• any equipment or network on which the Website is stored;
• any software used in the provision of the Website; or
• any equipment or network or software owned or used by any third party.
11.1 Whenever a Member makes use of a Website’s menu / feature that allows him/her to upload material to the Website, or to make contact with other Members of the Website, he/she must comply with the acceptable use policy set out in clauses 4 to 11 inclusive. The Member warrants that any such material does comply with that policy, and he/she will indemnify MAREFIND for any breach of that warranty.
11.3 MAREFIND will not be responsible, or liable to any third party, for the content or accuracy of any materials posted by any Member to the Website.
11.4 Materials / data uploaded must be accurate (where they state facts), be genuinely held (where they state opinions) and comply with applicable law in Cyprus and in any Country from which they are posted.
11.5 Materials uploaded by Members’ must not:
• be likely to deceive any person; be used to impersonate any person, or to misrepresent one’s identity or affiliation with any person;
• give the impression that they emanate from MAREFIND, if this is not the case;
• promote any illegal activity;
• be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence;
• infringe any copyright, database right or trade mark of any other person; advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse;
• contain anything that is defamatory of any person; or is obscene, offensive, hateful or inflammatory;
• promote sexually explicit material; promote violence; promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
• be threatening, abuse or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety; be likely to harass, upset, embarrass, alarm or annoy any other person;
• contain any direct contact details including email addresses, phone numbers, web addresses, Facebook and other Social media pages or similar unless it is expressly stated that they are allowed.
11.6 MAREFIND has the right to remove any material or posting a Member makes on the Website if, in MAREFIND’s opinion, such material does not comply with MAREFIND’s acceptable use policy set out in clauses 10 to 12 inclusive or as MAREFIND believes in its sole discretion is prudent or necessary to minimize or eliminate its potential liability.
11.7 MAREFIND shall not be responsible for the accuracy and completeness of a Member’s Contributions and for ensuring that that they are current and up to date.
11.8 MAREFIND has no obligation to Members, and undertakes no responsibility, to review their Contributions (including user-generated content) to determine whether they may result in any liability to any third party.
11.9 A Member shall indemnify MAREFIND against all damages, losses and expenses arising as a result of any action or claim that any material posted, or linked to, the Website by the Member constitutes a breach of
the Company’s acceptable use policy set out in clauses 10 to 12 inclusive.
12.1 MAREFIND may, from time to time, provide interactive services on the Website, including, without limitation, the “MareChat” Chat room.
12.2 Where MAREFIND provides any Interactive Service, MAREFIND will provide clear information to the Member about the kind of service offered, if it is moderated and what form of moderation is used (including whether it is human or technical).
12.3 MAREFIND will do its best to assess any possible risks for the Member from third parties when and if they use any Interactive Service provided on the Website. MAREFIND will decide in each case whether it is appropriate to use moderation of the relevant service (including what kind of moderation to use) in the light of those risks. However, MAREFIND is under no obligation to oversee, monitor or moderate any Interactive Service that MAREFIND provides on the Website. MAREFIND expressly excludes its liability for any loss or damage arising from the use of any Interactive Service by a Member in contravention of MAREFIND’s content standards, whether the service is moderated or not.
13.1 Access and registration to the Website for receipt of the services and/or execution of an Contact will require that Users / Members provide MAREFIND with those details that are necessary for the successful and secure delivery and receipt of the requested services, e.g. name, e-mail address, postal address, mobile phone number, etc. – as documented in detail in MAREFIND’s Privacy & Personal Data Protection Policy.
13.2 By entering the required data for the delivery of a service / execution of a transaction, users provide their explicit consent (opt-in) for the collection, use and processing of their personal data for the above purpose, in accordance with article 6, par. 1 of the General Data Protection Regulation (GDPR 2016/679), the “Protection of Personal Data” Cyprus Law N.125(I)/2018, the e-Privacy Directive 2002/58, and other applicable National (Cyprus) and European legislation, as in force from time to time.
13.3 MAREFIND takes all proper technical and organizational measures for the security and protection of personal data and observes all principles of lawful processing of personal data (lawfulness, fairness, transparency, purpose limitation, data minimization, accuracy, storage limitation, integrity, confidentiality and accountability). MAREFIND aims to protect the data subject’s (User / Member) rights (information, access, rectification, erasure, restriction of processing, data portability, right to object and non-automated individual decision-making based on profiling), in accordance with the GDPR, the Cyprus laws, the decisions of the Republic of Cyprus Office of the Commissioner for Personal Data Protection (DPA) and the written instructions and the Privacy and Data Protection Policy that is published in the Website.
13.4 In addition to the above mentioned in 13.3, it must be noted that Users / Members personal data are protected and are not fully visible to all and in all cases. For instance, a Service Provider’s full personal profile data (eg. full Name, personal contact telephone etc) are visible to a (Premium) Service User only after a “Contact” between them has been initiated and mutually accepted / agreed. Similarly, a Service User’s (Company’s) Name is initially shown as “Shipping Company” and is revealed to a Service Provider only after a “Contact” between them has been initiated and mutually accepted / agreed
13.5 “Remarks” – “rating” of Service Providers: Service Users, who have had experience from contacting / collaborating with a specific Service Provider, are entitled to (optionally) enter online their evaluation about this Service Provider, in the related Website menu. In doing so, they can enter a 1-up-to-5 star evaluation in fields related to Cooperation, Communicative Competence, Collaboration, Consistency etc, while being able to keep their Anonymity.
13.6 MAREFIND and legitimate third parties are entitled to use the contact details that a user has disclosed, in order to send information messages about their products and services, as well as relevant offers and/or announcements, provided that the user has provided an explicit consent by submission of a relevant declaration in our website (opt-in), which he/she may at any time withdraw (opt-out).
13.7 The user may withdraw the provided consent (opt-out) by according clicking online in his profile (My Account) settings or by sending an e-mail to email@example.com; such e-mail must be sent by the same e-mail address declared by the user upon registration, stating “I DO NOT WISH TO RECEIVE INFORMATION”. Alternatively, the user may select the option “DELETE ME FROM RECIPIENT LIST” on the e-mail received.
13.8 If they so wish, users may request at any time information about their personal data kept by MAREFIND, their recipients, the purpose of keeping and processing them, and their modification, correction or deletion, by sending a relevant e-mail to firstname.lastname@example.org from the e-mail address declared upon registration, attaching a copy of their ID card.
13.9 MAREFIND reserves the right to allow authorized access and/or grant rights to use and process personal data of users to third parties, legal or natural persons, which have been duly appointed by MAREFIND to perform processing that takes place with the same standards of data security as applied by MAREFIND being the Data Controller. MAREFIND may be obliged by prosecution and police authorities to provide the same access, in accordance with the applicable law.
13.10 MAREFIND reserves the right to use or transfer to third parties (for statistical, promotional, research and/or advertising purposes) the data / information communicated to it in a manner that it does not allow the identification or disclosure of the person it refers to, (e.g. by suitably anonymizing this data / information).
13.11 The details of access to MAREFIND’s services, if they have been chosen by the User / Member or they were automatically generated by MAREFIND’s systems and have been communicated to the User / Member (indicatively and not restrictively, Member codes, passwords etc.) are strictly personal and the User / Member is exclusively responsible to protect them from being disclosed, copied, challenged and communicated to third parties.
(a) immediate, temporary or permanent withdrawal of a membership and / or the right to use the Website;
(b) immediate, temporary or permanent removal of any posting or material uploaded by the Member to the Website;
(c) issue of a warning to the Member;
(d) legal proceedings against the Member for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach;
(e) further legal action against the Member; or
(f) disclosure of such information to law enforcement authorities as Company reasonably feel is necessary.
14.4 Subscriptions are not refundable. MAREFIND will not be entitled to refund any monies paid to MAREFIND by the Member if the Member wishes to cancel his/hers contract with MAREFIND for the supply of the Services pursuant to clause 7.
14.5 MAREFIND may cancel the contract with a Member for the supply of the Services at any time without a refund to the Member and with immediate effect by giving the Member’s notice if the Member does not pay MAREFIND when he/she is supposed to.
14.6 A subscription contract between MAREFIND and a Member, for the supply of Subscription-based Services, will continue until the Member does not renew his Premium / VIP Subscription - in accordance with clause 7.
14.7 If a Member is not subscribed as a Premium / VIP Member, he/she can, at any time, close his/her account if he/she no longer requires MAREFIND’s services.
15.1 Where the Website contains links to other sites and resources provided by third parties, these links are provided for information only. MAREFIND has no control over the contents of those sites or resources, and accepts no responsibility for them or for any loss or damage that may arise from Member’s use of them.
16.1 Applicable laws require that some of the information or communications MAREFIND may send to the Member should be in writing. When using the Website, the Member accepts that communication with MAREFIND will be mainly electronic. MAREFIND will contact the Member by email or provide him/her with information by posting notices on the Website. For contractual purposes, the Member agrees to this electronic means of communication and acknowledges that all contracts, notices, information and other communications that MAREFIND provides to the Member electronically comply with any legal requirement that such communications be in writing. This condition does not affect the statutory rights of the Member.
17.1 All notices given by the Member to MAREFIND must be given to MAREFIND INTERNATIONAL LTD, registered in Cyprus (Nikou Theofanous 4, Pallouriotissa, 1040 Nicosia, Cyprus) with TIC and VAT 10394164T.
17.2 MAREFIND may give notice to the Member at either the email or postal address he/she provided to MAREFIND when the Member joined the Website or place an order, or to the Member’s postal address (if given). Notice will be deemed received and properly served immediately when posted on the Website, 24 hours after an e-mail is sent, or three days after the date of posting of any letter. In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an e-mail that such an e-mail was sent to the specified e-mail address of the addressee.
18.2 A Force Majeure Event includes any act, event, non-happening, omission or accident beyond MAREFIND’s reasonable control and includes in particular (without limitation) the following: strikes, lock-outs or other industrial action; civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war; fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster; impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport; impossibility of the use of public or private telecommunications networks; and the acts, decrees, legislation, regulations or restrictions of any government.
20.3 Each of MAREFIND and the Member agree that their only liability in respect of those representations and warranties that are set out in this agreement (whether made innocently or negligently) will be for breach of contract.
20.4 Nothing in this clause limits or excludes any liability for fraud.
